A Los Angeles judge has ordered the Roman Catholic organization known as the Franciscans to turn over documents concerning child rape cases (I don’t see any benefit by referring to their heinous acts as the “clergy abuse scandal”). The group is, of course, trying to weasel out of it by claiming psychotherapist-patient privilege.
Brian Brosnahan, an attorney for the Franciscan Friars of California Inc., said in a statement that Lichtman’s decision to open the medical records to the public was counter-productive.
“The psychotherapist-patient privilege exists so that the patient will make full disclosure to the therapist without fear that the communications will become public information,”
However in most psychotherapist-patient sessions, cases of child rape are not involved. And if they are, the courts can subpoena the information. In any case, their reluctance to cooperate really makes me wonder if these people have any morals at all. But, when you have greater allegence to an invisible entity than you do to you fellow human beings, how can you be moral?
